EWSU PLEDGE PORTAL – DATA USE POLICY

PURPOSE

In order to better facilitate the ability for certain individuals or entities (“Pledgor(s)”) to provide financial assistance to customers of the Evansville Water and Sewer Utility (“EWSU”), the EWSU has created this portal (“Pledge Portal”) which allows a Pledgor to enter a customer’s account number and in return they will then be able to see a customer’s limited data set (“LDS”).  This Data Use Policy (this “Policy”) limits the Pledgor’s use of the customer’s LDS.

POLICY

By clicking “Agree” below, Pledgor expressly acknowledges, understands, and agrees that he/she/it will receive access to a customer’s LDS consisting of the following information: 

  1. Outstanding Balance Due; 
  2. Name of Customer; 
  3. Shutoff Date; and 
  4. Shutoff Amount.

PERMITTED USES 

By clicking “Agree” below, Pledgor expressly agrees to strictly limit his/her/its use and disclosure of the customer’s LDS provided by the EWSU to the Pledgor solely for the purpose of providing financial assistance to the particular EWSU customer in need of financial assistance (the “Permitted Use”).  In no event shall any such use or disclosure be for any purpose other than providing financial assistance.  No other uses or disclosure of the LDS are authorized or permitted.  

An LDS may be disclosed only if EWSU obtains satisfactory assurance, by Pledgor clicking “Agree” below, to be bound by this Policy, stating that the LDS recipient will only use or disclose the LDS for the Permitted Use.

PLEDGOR EXPRESSLY AGREES TO:

  1. Not use or further disclose the information other than as permitted by this Policy or as otherwise required by law;
  2. Use appropriate safeguards to prevent use or disclosure of the information other than as provided for by this Policy.
  3. Report to the EWSU any use or disclosure of the information not provided for by this Policy of which Pledgor becomes aware;
  4. Ensure the LDS is not further de-identified; and
  5. Not contact the customers.

CONFIDENTIALITY

By clicking “Agree” below, Pledgor expressly acknowledges, understands and agrees that the customer’s LDS information is personal and confidential in nature, and Pledgor agrees to hold such information in strict confidence and not to disclose or make available such information to any third party, except as required by law.  This provision shall survive termination of this Policy.

ACCURACY OF CUSTOMER INFORMATION

By clicking “Agree” below, Pledgor expressly acknowledges that he/she/it understands that the EWSU do not warrant or guaranty the accuracy of the customer’s LDS information and agrees to hold the EWSU harmless from any and all claims whatsoever as it pertains to any information disclosed via the Pledge Portal.

VIOLATION OF DATA USE POLICY

Pledgor understands that any violation of the terms of this Policy may be deemed a violation of either state or federal law and will result in immediate revocation of access to the Pledge Portal.
